The short version
You get a personal licence to play the game. You do not own the game, the world server or anything inside the shared world.
The Online Pass is an auto-renewing subscription that lets you play in the shared world. It renews until you cancel it in your App Store or Google Play account settings. Sandbox needs no subscription.
Seed Money and every other in-game currency are play money: no real-world value, no cash-out, no transfer.
The shared world is a live game that we keep changing and balancing. Play fair, and do not attack the server or other players.
1. Agreement
These Terms of Use (“Terms”) are an agreement between you and the developer of Orbital Frontier (“we”, “us”). They cover the Orbital Frontier application on iOS, iPadOS, Android, macOS and Windows (the “App”), the world server at orbital-frontier.world it connects to, and every subscription, purchase and piece of content in it (together, the “Service”). By downloading, installing or using the App you accept these Terms. If you do not accept them, do not use the App.
How we handle personal data is described in the Privacy Policy, which forms part of these Terms.
2. Your licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App for your own non-commercial entertainment, on devices you own or control, as allowed by the usage rules of the store you got it from. On Apple devices this means the Usage Rules in the Apple Media Services Terms and Conditions, including Family Sharing where Apple allows it.
You may not:
- copy, modify, sell, rent, lend, sublicense or redistribute the App or any part of it;
- reverse engineer, decompile or disassemble the App, or extract its asset pack, except where the law expressly allows it despite this restriction;
- use cheats, bots, modified clients or automated tools against the shared world, or send the world server anything the App would not;
- probe, overload, disrupt or try to gain unauthorised access to the world server, other players’ accounts or our systems;
- use the Service for anything unlawful, or to harass, impersonate or harm anyone.
The App, its code, art, sounds, text, worlds, parts, crew and every other element, and the Orbital Frontier name, are ours or our licensors’ and are protected by intellectual property laws. Everything not expressly granted to you here is reserved.
3. Accounts
Playing in sandbox needs no account. Playing in the shared world needs you to sign in with Apple, Google or an email address. You are responsible for keeping your sign-in secure and for what happens under your account. One account is one space programme; do not sell, share or transfer it except through the in-game sign-in code that moves your own sign-in between your own devices.
You can reset your programme or delete your account at any time in Settings → Account. Deleting an account removes its progress permanently; see Delete your account. You must be at least 13 years old, or the minimum age in your country if higher, to create an account.
4. The Online Pass subscription
The Online Pass is an auto-renewable subscription that gives your account access to play in the shared world while it is active. The name, length of each period and price of each subscription are shown in the App’s store screen and on the purchase sheet before you confirm, in your local currency.
- Payment. Payment is charged to your Apple ID account (App Store) or your Google Play account at confirmation of purchase, or at the end of a free trial if one was offered.
- Automatic renewal. The subscription renews automatically for the same period and price unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
- Managing and cancelling. You can manage or cancel the subscription in your account settings on the App Store (Settings → your name → Subscriptions) or on Google Play (Play Store → Payments & subscriptions → Subscriptions). Deleting the App or your account does not cancel it. Cancelling stops future renewals; access continues until the end of the period already paid for.
- Free trial. Where a free trial is offered, it is for new subscribers only, and it converts to a paid subscription at its end unless cancelled at least 24 hours before. Any unused part of a free trial is forfeited when you buy a subscription.
- Price changes. If the price changes, the store will tell you in advance and, where the law or the store’s rules require, ask for your consent before charging the new price.
- One programme, any platform. A subscription bought on one store gives access to your account wherever you sign in to it. It is tied to the account it was claimed on and is not transferable to another account.
When access ends, your programme, ships and progress stay as they are; you can keep playing in sandbox, and you pick the shared world back up when access resumes. We may change what the Online Pass includes as the game develops, but we will not take away shared-world access for a period you have already paid for.
5. In-app purchases and virtual currency
The App may sell consumable items such as Seed Money, which adds in-game credits to your account. Credits, discovery and every other in-game currency or item (“Virtual Items”):
- are a limited licence to use content inside the game, not property you own;
- have no monetary value and cannot be exchanged for real money, goods or anything outside the game, or transferred between accounts;
- are added to your account once the world server has confirmed the purchase with the store, and are spent by playing, like any other credits;
- may be rebalanced, repriced or changed as the game develops, and are lost if you reset your programme or delete your account.
Purchases are final except where the law or the store’s refund policy says otherwise. Refunds are handled by the store you paid: Apple at reportaproblem.apple.com, Google through Google Play. If a purchase is refunded, the credits it granted are removed from your account, down to a balance of zero.
6. The shared world
The shared world is a live, persistent service running on one clock that keeps moving while the App is closed. You accept that:
- the world server is the authority on what happened: it decides what your ships, crew, contracts and credits are, and a flight that it did not accept did not happen;
- we continually change the game — parts, prices, physics, rewards, contracts, worlds — and a change applies to ships already built and flying;
- ships and crew can be lost in play, including while you are away, because the world keeps running;
- the Service may be interrupted for maintenance, updates or reasons outside our control, and an out-of-date version of the App may be asked to update before it can play;
- names you give ships and crew must not be offensive, unlawful or impersonate anyone, and we may change or remove any that are.
Ship designs, names and other things you create in the game remain yours; you give us a worldwide, royalty-free licence to store, copy and use them as needed to run, show and improve the Service.
7. Suspension and termination
We may suspend or close an account that breaks these Terms — in particular cheating in the shared world, attacking the Service or abusing purchases or refunds — with or without notice where the breach is serious. You may stop using the Service and delete your account at any time. If we permanently shut down the shared world, we will announce it in the App or on this site in advance, and stop selling subscriptions before it closes.
8. Disclaimer of warranties
To the maximum extent the law allows, the App and the Service are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted, error-free or that progress will never be lost. Nothing in these Terms limits rights you have as a consumer that cannot lawfully be excluded.
9. Limitation of liability
To the maximum extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, progress, Virtual Items or profits, arising from your use of or inability to use the App or the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim. This does not limit liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law.
10. Apple App Store terms
If you got the App from Apple’s App Store, the following also apply:
- Acknowledgement. These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
- Scope of licence. Your licence is limited to using the App on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support. We are solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance or support services for it.
- Warranty. We are solely responsible for any product warranties not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App to you. To the maximum extent the law allows, Apple has no other warranty obligation whatsoever with respect to the App; any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent not disclaimed.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property. If a third party claims that the App or your possession and use of it infringes that party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with applicable third-party terms of agreement when using the App, such as your wireless data service agreement.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
11. Google Play terms
If you got the App from Google Play, your use of it is also subject to the Google Play Terms of Service, and Google’s refund and subscription policies apply to purchases made there. Google is not a party to these Terms and is not responsible for the App.
12. Changes to these Terms
We may update these Terms as the game changes. When a change matters, the date below changes with it, and where the change is significant we will say so in the App. Continuing to use the Service after that means you accept the new Terms; if you do not, stop using the Service and cancel any subscription.
13. Governing law
These Terms are governed by the laws of the country in which the developer is established, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there. If any part of these Terms is found unenforceable, the rest remains in effect.
